HOSPITAL: St Richard's fight could end in court
West Sussex health chiefs could face a legal challenge if plans go ahead to downgrade St Richard's and make Worthing the county's major general hospital.
Chichester District Council's executive board discussed putting in an application for a judicial review ahead of the Primary Care Trust board's vote on the recommendation yesterday.
If an application was accepted, it would mean a hearing in the high court to examine how the PCT reached the decision.
A judicial review can only challenge the way in which a decision has been made rather than the decision itself.
The cost would run into at least tens of thousands of pounds, but councillors believe they would have the backing of local residents if this proved necessary.
John Kingdon, the district director of health and community well-being, said the decision went against all good common sense and evidence.
