LETTER: '˜No such alternative highway has been constructed'

To Steve Howe, Lewes District Council Planning Officer and Lewes District Council Planning DepartmentCC Sussex ExpressRef Planning Application LW/15/0034 and the Associated Footpath Diversion of Public Footpath 40a

In accordance with paragraph three of the notice regarding the Footpath Diversion of Public Footpath 40a dated January 24, 2017, which appeared on Tide Mills, Newhaven on February 1, 2017, I am emailing to register an objection to this proposed footpath ‘stopping up and diversion’.

In support of my objection to the ‘stopping up and diversion’ of Public Footpath 40a I cite Lewes District Council’s own ‘Officers Report’ of August 10, 2015, reference ‘Committee Footpath’, a document within the ‘associated documents’ for Planning Application LW/15/0034 in which the closing recommendation states: The Order shall not come into force until the development proposed in LW/15/0034 is commenced, or such time as the use of Public Footpath 40a is compromised (eg, by fencing off of the development site). No such commencement of work or fencing has taken place.

Further in support of my objection to the ‘stopping up and diversion’ of Public Footpath 40a I cite Lewes District Council’s own Newhaven Port Public Path Diversion Order 1/2017 of January 24, 2017, again a document within the ‘associated documents’ for Planning Application LW/15/0034, which reads that a two-metre wide alternative highway should be constructed.

No such alternative highway has been constructed. Additionally in support of my objection to the ‘stopping up and diversion’ of Public Footpath 40a I cite Lewes District Council’s own ‘Decision Notice’ of December 23, 2016, ‘Notice of Planning Permission’, again a document within the ‘associated documents’ for Planning Application LW/15/0034, which details a whole raft of environmental and ecological mitigation measures associated with LW/15/0034.

Whilst there has been some work with regard to wildlife relocation it cannot be demonstrated that the many and varied raft of environmental and ecological mitigation measures referred to in the ‘Notice of Planning Permission’ of December 23, 2016, have taken place.
