Shakeel Sharif, 29, is accused of taking part in sexual acts with a 14-year-old girl from a Worthing care home, on Sunday, January 27, this year.
Addressing the jury on Monday, Judge Robert Fraser, said: “This case has unique features. You won’t be hearing from the girl. She’s refused to have anything to do with proceedings.
“There is no dispute there was sexual contact between them or the nature of the contact. The dispute is about Mr Sharif knowing her age.”
Sharif pleaded not guilty to both charges.
