LETTER: Presumption of innocence

It seems car owners are now being heavily fined and penalised for declining to admit to being the driver of their car when it was photographed speeding.

Does this mean that the right to silence and the presumption of innocence have been removed from statute?

If this is so as both are common law rights and statute law is subordinate to the common law why is this not being observed by the courts?
